Welcome to Moonshade! These Terms and Conditions ("Terms") govern your access and use of the Moonshade platform, including the website, desktop application, and all associated services (collectively, the "Service").
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access or use the Service.
2. Account Creation
Some features of the Service require you to create an account. You are responsible for maintaining the confidentiality of your account information, including your username and password. You are also responsible for all activity that occurs under your account.
3. Use of the Service

However, by uploading content to the Service, you grant Moonshade a non-exclusive, worldwide, royalty-free license to use, modify, publish, and distribute your content in connection with the Service.
You are responsible for ensuring that your content does not infringe on the intellectual property rights of any third party. You are also prohibited from uploading content that is illegal, obscene, defamatory, or otherwise harmful.
5. Desktop Application
The Moonshade desktop application is provided to you under a license agreement. You may not copy, modify, decompile, reverse engineer, or distribute the application without Moonshade's express written permission.
6. Disclaimer of Warranties
The Service is provided "as is" and without warranties of any kind, express or implied. Moonshade disclaims all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
7. Limitation of Liability
Moonshade will not be liable for any damages arising out of your use of the Service, including but not limited to direct, indirect, incidental, consequential, or punitive damages.
8. Termination
Moonshade may terminate your access to the Service at any time, for any reason, with or without notice. You may also terminate your account at any time.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Germany.

These Terms constitute the entire agreement between you and Moonshade regarding your use of the Service.

Moonshade Privacy Policy

Moonshade ("Moonshade," "we," "us," or "our") respects the privacy of its users ("you"). This Privacy Policy describes how we collect, use, and disclose your information when you use the Moonshade platform.

We collect two types of information about users:
- Account Information: When you create a Moonshade account using an oAuth login (eg. Discord), we collect your username, email and user ID from the chosen platform. We do not store your oAuth login credentials.
- Usage Data: We use TelemetryDeck to collect anonymous usage data about your interactions with the Service. This data may include information about the features you use, the frequency of your use, and any errors you encounter.
Use of Information
We use the information we collect to:
- Provide and improve the Service
- Analyze how the Service is used
- Troubleshoot and fix bugs
- Communicate with you about the Service
Data Storage and Security
All user data, except account information obtained via oAuth, is stored on servers located in Germany. We take reasonable steps to protect your information from unauthorized access, disclosure, alteration, or destruction. However, no security measures are perfect, and we cannot guarantee the security of your information.
